Veterinarians all over the state can now rest easier. Even the quacks.
It was all started by a dog who got out of his yard during a thunderstorm. He ended up in the Fort Worth animal shelter. Doggie jail.
Then came the unfortunate series of events that led to the dog being to sent to?um, greener pastures.
Jeremy Medlen came to get Avery, a mixed breed but didn?t have the money to bail him out. So the object of his ?sentiment? had to stay another night in a really horrid place.
By the time he got back to claim the dog, he found out it had been ?accidentally? put down. Even though the shelter had put a sign on it?s cage that said ?hold for owner?.
Medlen then sued the shelter and the apparently illiterate worker that killed the dog.
After some back and forth through the lower courts, the case went to the Texas Supreme Court after the 2nd Court of Appeals. They had ruled Medlen could sue for the ?sentimental? value of the dog.
But the Texas Supreme Court went by the earlier precedent and struck that ruling down. Pets only have a ?market value?.
As a mixed breed Labrador with no papers it?s doubtful Avery has much value over, say, 50 dollars. Less than the 80 dollars the shelter was charging Medlen to reclaim the dog.
The irony of the whole situation is if the illiterate shelter worker had accidentally destroyed a picture of the dog, Medlen could have sued for ?sentimental value?.
